WARRANTY

Upon showing proof of purchase and subject to the additional terms and conditions of this Warranty, your Product may be repaired or replaced by FMS Gaming. This Warranty may not be transferred to a third party and this Warranty shall be your sole remedy unless otherwise required by applicable law. By using your Product, you agree to, understand and accept the terms and conditions of this Warranty. IF YOU DO NOT ACCEPT THIS WARRANTY, DO NOT USE YOUR GAME CONTROLLER, HEADSET, OR ACCESSORY. RETURN YOUR GAME CONTROLLER, HEADSET, OR ACCESSORY TO FMS Gaming OR THE AUTHORIZED RESELLER FROM WHICH YOU MADE YOUR PURCHASE

To Start A Warranty Claim

In order to start a warranty claim You (the customer) agree to notify FMS Gaming via email at info@fmsgaming.com before the end of the agreed warranty period. Once You receive instructions via your provided email address on file from FMS Gaming you will have 14 calendar days to send your product to us.

If the requested product is not shipped by you before the 14 calendar days have expired then the warranty claim will not be honored and your product will no longer be considered covered under the warranty agreement even if the original warranty has not yet expired.

Any warranty claim that is submitted outside of the agreed warranty period (3 months, 6 months, or 9 months whichever is applicable) will not be honored. 

A "month" shall be considered 30 calendar days.

Warranties begin on the day your product is delivered, not the day the product is purchased.

Any and all products returned under a warranty claim will be tested and inspected to determine their eligibility for repair or replacement.

FMS Gaming will cover the shipping cost of legitimate warranty claims.

If it is determined that your product claim is not eligible for warranty repair or replacement then You (the customer) shall be responsible for all shipping costs to and from FMS Gaming.

STANDARD 3-Month Warranty (LIMITED)

All FMS Gaming products carry a STANDARD 3-Month Warranty (unless stated otherwise) on defective parts, faulty workmanship during the manufacturing process, and the modchip installation and functionality. This Warranty does not cover:

  • Alterations to or tampering with the Product, including attempts to open, dismantle, customize, modify, or self-repair the Product.
  • Exposure of the Product to extreme temperatures or conditions.
  • Attempting to charge or recharge a Product through a wall outlet and/or attaching the Product to a defective power cord or power cord that exceeds the rated tolerance for the Product.
  • Electrical damage from power surges, lightning, or other sources external to the Product.
  • Scratches, dents, or other cosmetic changes which alter the Product or appearance of the Product from its original state.
  • Normal "Wear and Tear" – Deterioration and/or failure that results from normal use, wear or aging.
  • Intentional or negligent damage to the Product by the user, such as by misuse, dropping, throwing, or otherwise abusing the Product.
  • Unreasonable or excessive use of the Product, including commercial use.
  • Exposure of the Product to fluids, moisture, or chemicals.
  • Thumbstick damage/defect or Thumbstick drift.

or anything of the sort that may be determined by inspection in FMS Gaming workshop.

 

EXTENDED 6-Month Warranty (LIMITED)

The EXTENDED 6-Month Warranty is not an extension of the STANDARD 3-Month Warranty, but rather replaces it. This will cover the following (unless stated otherwise), defective parts, faulty workmanship during the manufacturing process, and the modchip installation and functionality, thumbstick damage/defect and thumbstick drift (covered by Thumbstick Protection Plan). This warranty does not cover: 

  • Alterations to or tampering with the Product, including attempts to open, dismantle, customize, modify, or self-repair the Product.
  • Accessories (EVA Travel Cases, USB Charging Cables)
  • Exposure of the Product to extreme temperatures or conditions.
  • Attempting to charge or recharge a Product through a wall outlet and/or attaching the Product to a defective power cord or power cord that exceeds the rated tolerance for the Product.
  • Electrical damage from power surges, lightning, or other sources external to the Product.
  • Scratches, dents, or other cosmetic changes which alter the Product or appearance of the Product from its original state.
  • Normal "Wear and Tear" – Deterioration and/or failure that results from normal use, wear or aging.
  • Intentional or negligent damage to the Product by the user, such as by misuse, dropping, throwing, or otherwise abusing the Product.
  • Unreasonable or excessive use of the Product, including commercial use.

ULTIMATE 9-Month Warranty (LIMITED)


The ULTIMATE 9-Month Warranty is not an extension of the STANDARD 3-Month Warranty or the EXTENDED 6-Month Warranty, but rather replaces them. This will cover the repair and/or replacement of this product in full with any and all previously added modifications (if available and/or applicable) if it is damaged or defective for any reason regardless of cause or fault no questions asked. This warranty includes a Thumbstick Protection Plan. Limit 1 full repair/replacement per warranty duration (for the ULTIMATE 9-Month Warranty only)

This warranty does not cover accessories (EVA Travel Case or USB Charging Cable)

In the event that a repair/replacement of all or part of the product is not available, the customer will have the option to pick from one of the following:

1. Exchange all or part of the product with a similar product or part of equal or lesser value to the amount originally paid for the product itself (warranties, rush build times, and shipping costs shall not be included when determining similar product value) if applicable.

OR

2. A full refund of the ULTIMATE 9-Month Warranty ($50 or $90 whichever is applicable) to the original payment method, in the form of a gift card, or an online discount code to use at Fmsgaming.com.

If a product is repaired or replaced under this policy the new product will be covered under the STANDARD 3-Month Warranty only. If the repair or replacement takes place before the ULTIMATE 9-Month warranty expires then the Standard 3-Month warranty will not be an extension of the remainder of the ULTIMATE 9-Month warranty, but rather replaces it.

Thumbstick Protection Plan

Thumbstick Protection Plan is not an extension of any warranty but is instead a separate protection plan offered by FMS Gaming. It begins on the day your product is delivered. The duration is 3-months (when purchased), 6-months, or 9-months (whichever is applicable).

This covers the 1-time repair or replacement of the defective or damaged Thumbstick or Thumbstick Modual as well as the shipping costs for FMS Gaming to recieve and send the product back to the consumer.

WHAT TO DO IF YOUR WARRANTY EXPIRES

If your Product is no longer covered by the Warranty, you are responsible for one hundred percent (100%) of the cost to repair or replace the Product as well as all shipping costs to and from FMS Gaming. Once we receive your Product, we will inspect it and after completing our inspection, we will contact you and inform you of the total repair or replacement cost. If your Product is not covered under any of the listed warranty agreements, your Product will not be repaired or replaced until we receive payment from you. Failure to pay for the cost of repairs or replacement of your Product, may result in the Product being shipped back to you unrepaired at your expense.

 REPAIRS

We offer repair services for standard PS5 and Xbox Series X/S controllers (this excludes pro controllers).

If you have a controller that was modded by FMS gaming but it is out of warranty, you may request repair services as well.

Repairs to controllers can be requested by contacting us at info@fmsgaming.com. You will be responsible for all shipping fees to and from FMS Gaming as well as all parts and labor costs.

LIMITATION OF LIABILITY (A)

FMS Gaming is not responsible for any (a) incidental, direct or indirect, punitive or consequential damages, (b) loss of profits, any loss of privacy or confidentiality including the loss of personal information, banking account information or any other confidential information provided by you to us during your purchase of or Warranty claim for a Product, (c) injury or death or (d) loss to real or personal property. Such limitation shall exist even if FMS Gaming knew of the possibility of such loss or damage or had reason to know of such loss or damage. All rights due to you shall be limited and solely contained within the terms and conditions of this Warranty, unless otherwise required by applicable law.

 

LIMITATION OF LIABILITY (B)

  • Unless otherwise required by law, the terms and conditions of this Warranty shall be governed by the laws of the State of Michigan in the United States of America without regard to its conflict of law provisions. All disputes which occur or arise from this Warranty shall be disputed and resolved where the Company is located.
  • As a user of the Product, you understand, agree and accept the terms of this Warranty and agree to abide by any Product Terms and Conditions not contained herein, but shall be deemed a part of the Warranty as if originally included herein. This Warranty gives you specific legal rights and you may also have other rights which vary from state to state.
  • Product replacements in the event of a Warranty claim are subject to Product availability. In the event of supply difficulties, Products no longer in stock, or discontinued Products, we reserve the right to substitute Products of an equal or higher quality and value in our sole discretion as satisfaction of a Warranty claim.
  • Certain states or nations may give consumers rights in addition to those provided by this limited warranty.
